Can foreigners get an administrative divorce in Thailand?
Yes. If both spouses mutually consent to divorce and agree on all terms (property, custody, support), they can register the divorce at the Amphur (district office) without going to court. At least two witnesses must be present. This is the fastest and most cost-effective way to divorce in Thailand.
What is the difference between administrative and judicial divorce?
Administrative divorce is done by mutual consent at the Amphur and takes about one day. Judicial divorce requires filing a lawsuit in Thai Family Court and is necessary when spouses cannot agree or when specific grounds (adultery, abandonment, etc.) must be proven. Judicial divorce can take 6-12 months.
How is marital property divided in Thailand?
Under Thai law, Sin Somros (community property acquired during marriage) is divided equally between spouses. Sin Suan Tua (personal property owned before marriage or received as gifts/inheritance) remains with the original owner. Spouses can agree to a different division in their divorce agreement.
What about child custody in a Thai divorce?
In an administrative divorce, parents must agree on custody. Under Thai law (Section 1520), after divorce, parental authority belongs to the parent awarded custody. Joint custody is not formally recognized under Thai law, but parents can agree on shared parenting arrangements in the divorce agreement.
Is this divorce agreement recognized internationally?
A Thai administrative divorce is legally valid in Thailand. For recognition in other countries, you may need to have the divorce certificate legalized or apostilled by the Thai Ministry of Foreign Affairs. Some countries require additional proceedings to recognize a foreign divorce.
